Nestlé, a Swiss multinational food and beverage company, has a rich history dating back to its founding in 1866 by Henry Nestlé. Initially focusing on milk-based products for infants, Nestlé quickly expanded its product range and global reach. The company is now a major player in the food industry, offering a diverse array of products, from baby formula and coffee to chocolate and pet food. Nestlé has developed a robust brand portfolio with recognizable logos and packaging for its various products.
In recent years, the company has filed multiple trademark lawsuits against companies producing imitation products or utilizing similar packaging that could confuse consumers. Amongst some of the most notable cases, in 2013, Nestlé was involved in a trademark dispute with Cadbury (now owned by Mondelez International) in the United Kingdom. Nestlé sought to trademark the shape of its four-fingered Kit Kat chocolate bar. Cadbury opposed the application, arguing that the shape lacked distinctive character. The case went through various legal proceedings, and at one point, the European Court of Justice ruled that Nestlé had not proven the distinctiveness of the shape. The dispute continued for several years, with the final outcome involving a setback for Nestlé's attempt to secure a trademark for the Kit Kat shape.
